A Legal Disclaimer

These Terms and Conditions (“Terms”) govern the relationship between Stewarts Window Tinting Plus, LLC (“we,” “us,” or “our”) and the customer (“Client,” “you,” or “your”) for residential, commercial, and window/glass tinting services.

Scope of Services

We agree to provide window film installation services as specified in your written estimate or service agreement. Any modifications to the project scope must be agreed upon in writing.

Client Responsibilities

To ensure the highest quality installation, the Client is responsible for:

Access: Providing clear access to all windows. For commercial or residential projects, all items (furniture, window treatments, etc.) within 3 feet of the glass must be removed before we arrive.
Cleanliness: Presenting vehicles in a reasonably clean condition. Excessive dirt, dust, or pet hair increases the risk of contamination (bubbles or specks) in the film.
Pre-existing Damage: Notifying us of any pre-existing scratches, chips, or glass defects.

Curing and Aftercare

Curing Period: Do not roll down tinted vehicle windows for 3–5 days after installation to allow the film to cure properly.
Visual Imperfections: It is normal to see water bubbles or "haze" during the drying process, which can take up to 60 days to fully evaporate. Do not touch or press on these bubbles.
Cleaning: Only use ammonia-free cleaners and soft microfiber cloths. Abrasive tools will scratch the film and void the warranty.

Legal Compliance

Local Laws: You are responsible for ensuring your selected tint level complies with local and state laws (e.g., Visible Light Transmission or VLT limits).
Waiver: By requesting a tint level that does not meet legal standards (e.g., for off-road or show use only), you release us from all liability regarding traffic citations or legal infractions.
We are HIPAA compliant.

Warranties and Limitations

Manufacturer Warranty: Film defects like fading, peeling, or bubbling are covered by the manufacturer's warranty.
Exclusions: Warranties do not cover physical damage (scratches from rings, jewelry, or pets), misuse, or acts of God.
Glass Breakage: While rare, some films increase thermal stress on glass. We are not responsible for glass breakage unless a specific "Thermal Shock" warranty was purchased.

Limitation of Liability

Our total liability for any claim arising from our services is limited to the amount paid for those services. We are not liable for incidental or consequential damages, including loss of use of your vehicle or property.

Governing Law

These terms are governed by the laws of the State of Indiana.

Commercial Project Deposits & Payment Terms

For all commercial projects, the following financial terms apply:

Initial Deposit: A non-refundable deposit of 33% of the total project estimate is required to secure your installation date and initiate material procurement.
Custom Material Orders: Any specialized or custom-ordered window film must be paid for in full (100%) prior to the order being placed.
Final Payment: The remaining balance is due immediately upon completion of the installation.
Project Suspension: We reserve the right to suspend or terminate ongoing work if any invoice remains unpaid past the stated due date.
Acceptable forms of payment are cash. check, or card.

Marketing & Photo/Video Release

By commissioning our services, you grant Stewarts Window Tinting Plus, LLC the following rights regarding media captured at the project site:

Grant of Rights: You authorize us and our agents to capture and use photographs or videos of the completed work for promotional, advertising, and marketing purposes.
Authorized Platforms: This includes, but is not limited to, our company website, social media profiles (Instagram, Facebook, TikTok, etc.), and printed marketing materials.
Likeness Waiver: For residential projects, we will make every effort to avoid capturing identifiable residents or personal documents. However, you waive any right to inspect or approve the finished media prior to its publication.
Ownership: You acknowledge that all media captured by our team remains the exclusive property of [Insert Business Name] and will not be returned.
Compensation: You agree that no monetary compensation or royalties will be provided for the use of these images or videos.

Service Eligibility

At Stewart's Window Tinting Plus, we are committed to operating in full compliance with all applicable tax laws and regulations. As a result, we are unable to provide services to organizations that hold 501(c)(3) tax-exempt status or to entities directly affiliated with those organizations.
